Understanding the Importance of Legal Notices

Why legal notices matter, what a well-drafted notice contains and why a notice you receive deserves a considered response.

Legal notices can be used for payment demands, contractual disputes and other formal communications. Their purpose and legal requirements depend on the proposed remedy; not every dispute requires the same notice.

What a legal notice does

A legal notice is a formal written communication that sets out a grievance, a demand or a position. It places that position on record and, in some proceedings, is a required step before a case can be filed.

Elements of a careful notice

A well-drafted notice states the relevant facts accurately, refers to supporting documents, identifies the relief sought and allows a reasonable time to respond. Overstatement can weaken an otherwise sound position.

Receiving a notice

Note the date you received it and keep the envelope. Read it carefully, gather the documents it refers to and seek advice before replying. A measured reply can be as important as the notice itself.

Statutory notice and ordinary correspondence

Some enactments prescribe the contents or timing of a notice before a particular proceeding. An ordinary demand letter should not be assumed to satisfy those requirements. Keep proof of dispatch and available delivery information with the text sent.

Key considerations

  • Preserve the notice, envelope and delivery details.
  • Separate a private notice from a court summons or order.
  • Mandatory notice periods depend on the applicable statute and facts.
